Terms of Service
Using the site means you agree.
By accessing or using the Propelled MD website (the "Site"), including by submitting The Workup intake, you agree to these Terms of Service (the "Terms"). If you do not agree to any part of these Terms, do not use the Site.
These Terms are a binding agreement between you and Propelled MD ("we," "us," "our"). Read them before you submit a Workup.
What we do, and what we do not.
Propelled MD is a custom digital-architecture firm that builds websites, authority systems, and related services for physicians and medical practices. We are a professional services firm, not a platform or a software-as-a-service product.
We are not a medical provider. Nothing on this Site is medical advice. Content published on this Site is educational and business-oriented. It is not a substitute for professional medical judgment, and you should not rely on it for clinical decision-making.
The diagnostic intake and what it does, and does not, create.
The Workup is a free diagnostic intake. Submitting The Workup does not create a partnership, a contract, or any obligation between you and Propelled MD beyond what is described in these Terms and in our Privacy Policy.
In exchange for the information you submit, we will deliver a written diagnostic report within five business days, offer an optional 30-minute strategy call, and confirm, in writing, whether your market is open, reserved, or held under The Selection protocol. Beyond that, there is no obligation on either side.
The Workup report is delivered for your use. It does not substitute for, nor does it create, a legal or business relationship with Propelled MD.
You own what you submit.
You retain all ownership of information you submit through The Workup or other Site forms. You grant Propelled MD a limited, non-exclusive license to use that information strictly to deliver the services you requested, including preparing and sending the diagnostic report, confirming market availability, and responding to your inquiries.
You represent that the information you submit is accurate to the best of your knowledge, that you are legally authorized to submit it on behalf of any practice or entity you reference, and that the information does not infringe third-party rights.
What lives on this Site belongs to us.
All content on the Propelled MD website, including text, graphics, logos, layouts, code, the sigil mark, trademarks, the Vanguard Journal articles, and the brand language (including "The Mandate," "The Selection," "The Methodology," "The Workup," "The Vanguard Journal"), is the property of Propelled MD or its licensors, protected by copyright, trademark, and other intellectual-property laws.
You may view and read Site content for personal, non-commercial purposes. You may not copy, republish, repurpose, scrape, or build competitive services using our content without express written permission.
When Propelled MD builds a custom website or authority system for a client under a signed engagement, the deliverables produced for that client are licensed or transferred under the terms of that separate engagement agreement, not under these public Terms.
What you agree not to do.
When using the Site, you agree not to:
- Submit false, misleading, or impersonating information through any form
- Use the Site to transmit spam, malware, or automated attacks
- Attempt to access administrative areas, server logs, or other non-public systems
- Reverse-engineer the Site, scrape it systematically, or copy protected content
- Use our brand marks or the names of our instruments to imply affiliation you do not have
- Use the Site for any unlawful purpose
Violation of this section may result in immediate termination of your access to the Site and, where appropriate, legal action.
We link out. We do not endorse.
The Site may contain links to third-party websites or reference third-party services (search engines, SMTP providers, article sources, etc.). We provide these for convenience and context. We do not control or endorse third-party sites, and we are not responsible for their content, terms, or privacy practices. Use them at your own discretion.
The Site is provided as-is.
The Site and its content are provided on an "as-is" and "as-available" basis without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.
We do not warrant that the Site will be error-free, that defects will be corrected on any schedule, or that the Site will be free of viruses or other harmful components. Use of the Site is at your own risk.
Any statements about typical results, timelines, or outcomes, on this Site, in The Workup report, or in any published content, are informational and illustrative. Results depend on factors outside of our control, and nothing here is a guarantee of any specific outcome.
What we are not liable for.
To the maximum extent permitted by law, Propelled MD, its principals, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, including lost profits, lost revenue, lost data, or business interruption, even if we have been advised of the possibility of such damages.
In no event will our aggregate liability to you for any claim arising out of or related to the Site or these Terms exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you have paid to Propelled MD in the twelve months preceding the claim (which, for Site use alone, is typically $0).
Some jurisdictions do not allow limitation of certain damages, so parts of this section may not apply to you. Other limitations remain in force to the extent permitted.
What you agree to cover.
You agree to indemnify, defend, and hold harmless Propelled MD and its principals from and against any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, your submission of false or infringing information, or your breach of any applicable law.
How access can end.
We may suspend or terminate your access to all or part of the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including 05, 08, 09, 10, and 12) will survive.
Where disputes are handled.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.
If applicable law grants you mandatory consumer protections that cannot be waived by contract, those protections apply in addition to anything stated here.
We will tell you.
We may update these Terms as the business evolves or as required by law. Material changes will be indicated by an updated version number and effective date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms. If you do not agree with a revision, stop using the Site.
